General terms of the Long Distance KTEL Bus Itineraries Information service, PLIROFORIKI METAFORON S.A. .


1. Scope of the Service

1.1 PLIROFORIKI METAFORON (which will be hereafter called as the “Company”) will provide the services described below according to the Greek law about telecommunications, consumer protection and personal data. The Company may offer to the users (who will be hereafter called as the “Customer”) access to the services provided via 14505 through interconnection contracts with other telecommunication providers.

1.2 The contract between the company and the client will be deemed as having been concluded in all cases when a Customer dials 14505 and achieves a successful telephone communication from the company’s network, and it lasts only for the time of the corresponding telephone call with the Company’s network.

1.3 14050 provides information about the long-distance bus itineraries of KTEL, on the basis of the relevant pricelist.


2. Method to provide the service

2.1 The company provides the above information by using an IVR system or via qualified operators.

2.2 The provision of the services depends on the data availability. The company reserves the right to amend, discontinue or active this specific service at any time.

3. Call completion service

3.1 Upon announcing the result of the search the company may connect the user with the telephone information services operated by the Company itself or by third parties and also provide information from other available sources, whose accuracy however cannot be guaranteed or checked by the company.


4. Service Pricing

4.1 The customer is charged on the basis of the pricelist, applying from time to time, of the telephone network he is subscribed in at the time of the provision of the service. The pricelist may be amended at any time, on the basis of the telecommunications law, the law about customer protection and EETT’s decisions.

a)Minimum charge 30” and charge per second after the first 30” seconds
b)The above prices include VAT 23%


5. Terms of Payment

5.1 The customer is required to pay the priced amount, which is based on the corresponding pricelist of the telecommunication network he is subscribed in at the time of provision of the service.

5.2 The customer’s obligation to pay will remain in the case that third parties make use of the service through the customer’s telephone connection, as well as in the case when there is not enough evidence, or in case of failure to complete the call due to operational or technical failure of the other networks or the called party.

5.3 A breakdown of charges may be issued to the customer, following an application, by the customer’s telecommunication provider.

6. Refusal to provide the service

The company is entitled to refuse, in whole or in part, to provide the service in case that : a) the customer makes unlawful use of the service in breach with the contractual terms, b) endangers the facilities of the company by using deffective terminal equipment or other means c) the amounts payable by the customers to the provider are significantly high and may be considered as bad, or when it is reasonable to believe that the customer, on the basis of previous outstanding debts, will not pay the current price.


7. Objections

In case that the customer has any objections with regards to the amounts charged by the company, he is required to notify his objections to the provider in writing within four (4) weeks since the date of issuance of the bills, otherwise he will be deemed as having accepted the charges.

 
 

8. Non satisfactory services by third parties

In case that the data are provided by third parties, the company has no obligation to ensure the correctness and accuracy of the data and/or any non compliance with the applying law, and/or any conflict with third party rights.


9. Liability of the company

9.1 The company will not be liable against the customer for any property damage incurred by the later due to the use of the company’s services.

9.2 In case of force majeur events that prevent the company from implementing the contract, the company will be entitled to suspend the provision of the service for as long as the force majeur exists, including a reasonable period to restart.

9.3 The company is not liable for the availability and accuracy of the itineraries requested through the long-distance KTEL itineraries service, or for the successful implementation of the connections via the call completion service. Moreover, the company will not be liable for the content of the conversation created between the customer and the called party through the completion call service which is only provided as a technical means of the connection.

9.4 In the event that the caller requests the call diversion service , the company will be obliged to satisfy this request and will not be liable for any call restrictions (i.e. call barring) which may be agreed upon and applied by the provider, at the order and on behalf of the customer.

9.5 The company does not guaranty the availability of its services from public telephone booths or telephone devices/ switchboards with call barring.


10. Responsibilities of the Customer

10.1 The Customer is required to comply with the terms regarding the provision of the service and the applying law.

10.2 The Customer must comply with the provisions of the Greek law about the protection of personal data. Non compliance will result into revocation or interruption of the service by the company.


11. Confidentiality

11.1 The personal data of the Customer will be collected, processed or used only within the scope of the current contractual relationship and to the extent that is deemed necessary by the interested party according to the law about protection of personal data (Law 2472/1997 as applying) and according to the telecommunications law and the terms of the administrative permits for the provisions of the service held by the company.

11.2 The Customer consents to and acknowledges that the conversations with the operator will be probably supervised by other employees of the company for quality control and service improvement purposes.

11.3 The customer’s connection with the service entails, on behalf of the customer, acceptance of all the terms of use of the service as well as consent, by the customer, regarding keeping his data in the company’s data base for the purpose of managing the charges of the service and updating in terms of new products or services. The personal data of the customers will be kept in a file which will be subject to classified access, safety and confidentiality according to the provisions of Law 2472/1997 and will not be transmitted or disclosed to third parties, with the exceptions of the following paragraph :

11.4 The customer consents to and acknowledges that for billing purposes the company may keep a file and transmit it to the corresponding telecommunications provider, of fixed or mobile telephony, as follows :
a) Caller identification data of the telephone connection (CLID), where the calls to 145050 originate from.
b) Data that specify the duration of the call (date, onset time, end time) when the customer obtained access to the KTEL long distance information service.

11.5 The Company has created a special line for complaints, without additional charge, so as to provide information about any question asked by the consumers about the 14505 KTEL service. Customers may contact the Company through 210 8108211.
